With his statement that the „Third Reich“ was not „highly treasonable“, the jurist Fritz Bauer denied the Nazi state any legitimacy. A few examples will illustrate just how alone he was in this and how it stood in stark contrast to the case law of the time, especially that of the Federal Court of Justice and its President Hermann Weinkauff.

Ingo Müller, Dr jur., Dr phil., retired professor of criminal law and criminal procedure at the Hamburg Police College, author of publications mainly on the history of justice; best known, with translations into English, Chinese, Spanish and Swedish: Furchtbare Juristen, 7th edition 2017.
